1. About these Terms
These Terms of Service ("Terms") are an agreement between you and Tvarific Event Solutions ("Tvarific", "we", "us"). They apply when you visit tvarific.com, create an account in the Tvarific client portal, order an Autonomous build, use the Builder, or sell tickets through an event site made with Tvarific (together, the "Services").
If you use the Services for a company or other organisation, you confirm that you can accept these Terms for it, and "you" means that organisation. If you do not agree to these Terms, do not use the Services.
Our Privacy Policy explains how we handle personal data and forms part of these Terms.
2. The Services
Tvarific helps event organisers publish event websites. There are two ways to build:
- Autonomous Build. You send a brief (event details, description and any files you attach). We write the copy and build the site, usually with a first version ready for review within about 120 minutes. You review it in the client portal and either approve it or ask for changes. Nothing is published until you approve it. Build times are typical, not guaranteed.
- Builder. You design your own site in our drag-and-drop editor from a template or a blank canvas, under one of the Builder plans described below.
Both include hosting on our infrastructure, connecting your own domain, registration and ticketing, and per-page analytics. We may improve, change or retire features over time. If a change materially reduces a paid feature you rely on, we will tell you in advance.
3. Accounts and workspaces
- You need an account to use the client portal. Give accurate details, including your country (it decides which billing currencies and payment partner apply to you) and keep them up to date.
- Keep your sign-in details secret. You are responsible for activity in your account and must tell us promptly at support@tvarific.com if you suspect unauthorised use.
- The account owner can invite team members to the workspace and choose what each can do. The number of team members depends on your plan. You are responsible for what your team members do in the workspace.
- You must be at least 18 and able to enter a binding contract to create an account.
4. Builder plans, trials and billing
Plans. The Builder is offered on the Starter, Growth, Agency and Enterprise plans. Each plan sets limits such as the number of event sites, custom domains and team members, as shown on our pricing page. Current list prices are Starter: $49 or ₹3,999 a month; Growth: $149 or ₹11,999 a month; Agency: $399 or ₹32,999 a month. Yearly billing costs 10 × the monthly price. Enterprise is priced by agreement. Taxes are added where they apply.
Free trial. Each workspace can start one 14-day free trial without a card. During the trial you can switch between self-serve plans. When the trial ends, Builder access stops until you subscribe; your sites and content are kept.
Currency. Plans are billed in US dollars. Accounts based in India can also pay in Indian rupees. Payments are processed by Razorpay.
Renewal. Subscriptions renew automatically at the end of each monthly or yearly period, and we charge the payment method you authorised at the price then in effect, until you turn off auto-renewal. You can turn it off at any time in Settings › Billing; your plan then runs to the end of the period you have paid for. You can also pay once for a single period without auto-renewal.
Changing plans. Upgrades take effect immediately and you pay the prorated difference for the rest of the period. Downgrades take effect at the end of the current period. If you move to a plan with lower limits, you may need to remove sites, domains or team members first.
Refunds of fees. Subscription fees are not refundable, including for partly used periods, except where the law requires a refund or we decide otherwise. If a payment fails, we may retry it and suspend Builder access until it succeeds.
Price changes. We may change plan prices. We will give you at least 30 days' notice before a new price applies to your renewal.
5. Autonomous builds
- Autonomous builds are quoted per event site. The quote, scope and price are confirmed with you before we start.
- You are responsible for the accuracy of your brief and of the event details, prices, dates, speaker names and other facts on the site. Check every version before you approve it.
- Approving a version authorises us to publish it on your chosen domain. You can ask for changes before approval as many times as your quote allows.
- We use automated tools, including artificial intelligence, to draft copy and layouts from your brief. Automated output can contain mistakes, which is why every site goes through your review.
6. Ticket sales (Tvarific Payments)
If you sell tickets, take registrations with a fee or accept donations through your event site, payments are handled by Tvarific Payments:
- Payment partners. Payments are processed by Razorpay for organisers based in India and by Stripe for organisers elsewhere. To receive money you must set up a payout account and complete the partner's identity and business verification. Their own terms (for Stripe, the Stripe Connected Account Agreement) also apply to you.
- Platform fee. Tvarific keeps a platform fee of 2% of each successful transaction, unless we agree a different rate with you in writing. The payment partner's processing charges are also deducted. Both are shown in the client portal.
- Payouts. Your share of each payment (the amount paid, less the platform fee and processing charges) is held and released to your payout account after your event ends, normally within 3 days. We may release it earlier. We may delay a payout while we look into suspected fraud, a dispute or a breach of these Terms.
- Refunds and disputes. You set your event's refund policy and must show it to attendees. You can refund attendees from the client portal. Refunds, chargebacks and disputes are deducted from your payouts; if they exceed what we hold for you, you agree to repay the difference. Where a refund is issued after the platform fee was charged, the fee may not be returned.
- Your responsibilities. You are the seller of your tickets. You are responsible for delivering the event, for honouring tickets, for the accuracy of prices and for any taxes on your sales.
7. Your content and your attendees
You keep ownership of everything you give us or add to your sites: briefs, text, logos, images, files and attendee data ("Your Content"). You give us a worldwide, non-exclusive licence to host, copy, adapt and display Your Content only as needed to provide, secure and improve the Services, including publishing your sites and showing them in your workspace.
You confirm that you have the rights to Your Content and that it, and your use of the Services, comply with the law. For personal data you collect from attendees, visitors and team members (for example registrations, booking questions or analytics you ask us to install), you are responsible for having a lawful basis, giving the notices and collecting any consents that are required, including for cookies and tracking tools on your site. We process that data on your behalf as described in our Privacy Policy.
You may show that a site was built with Tvarific. Unless you tell us otherwise, we may name your organisation as a customer and show public pages of your published site in our marketing.
8. Acceptable use
You must not use the Services to:
- publish anything unlawful, deceptive, defamatory, hateful, sexually exploitative or that infringes someone else's rights;
- sell tickets to events that do not exist, run fake fundraisers, or otherwise defraud attendees or donors;
- collect payment card details outside the checkout we provide, or impersonate another person or organisation;
- send spam, distribute malware, or attempt to break, overload, scrape or get around the security or limits of the Services;
- resell or provide the Services to others except as your plan allows (for example, agency workspaces serving their clients).
We may remove content or suspend a site that breaks these rules, and will tell you why unless the law or the safety of others prevents it.
9. Our intellectual property
The Services, including the editor, templates, blocks, designs and software, belong to Tvarific and its licensors. While you use the Services, we grant you a limited, non-transferable right to use them and to publish sites built with our templates. You may not copy, modify or reverse-engineer the Services except as the law allows.
If you send us feedback or ideas, we may use them without any obligation to you.
10. Third-party services
The Services rely on, or let you connect, services run by others, such as payment partners, email delivery, cloud hosting, domain registrars and analytics tools. We are not responsible for those services, and your use of them may be subject to their own terms. If a third party changes or stops a service, we may have to change or stop the related feature.
11. Availability and support
We work to keep the Services available and your sites online, but we do not promise that they will be uninterrupted or error-free. We may carry out maintenance, preferably at quiet times. Support is available by email at support@tvarific.com; Enterprise plans may include extra support agreed in writing.
12. Suspension and termination
You can stop using the Services at any time and ask us to close your account. Turning off auto-renewal stops future charges; closing the account does not refund fees already paid.
We may suspend or end your access if you seriously or repeatedly break these Terms, do not pay fees when due, or if we must do so by law. Where reasonable, we will warn you first and give you time to fix the problem.
After your account ends, your sites go offline. You can ask us to export Your Content within 30 days; after that we may delete it, subject to records we must keep by law (for example, payment and tax records). Sections that by their nature should continue (such as payment obligations, liability limits and disputes) survive termination.
13. Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available". To the extent the law allows, we disclaim all implied warranties, including of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee ticket sales, attendance, search rankings or any business result.
14. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill, arising from these Terms or the Services.
To the extent the law allows, our total liability for all claims in any 12-month period is limited to the greater of (a) the fees you paid us for the Services in that period, including platform fees, and (b) US $100.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
15. Indemnity
You will defend and compensate Tvarific against claims, losses and reasonable costs brought by third parties (including your attendees and donors) that arise from Your Content, your events, your ticket sales or your breach of these Terms or the law.
16. Changes to these Terms
We may update these Terms as the Services or the law change. We will post the new version here with a new "Last updated" date and, for material changes, tell you by email or in the client portal at least 30 days before they apply. If you keep using the Services after that, the new Terms apply; if you do not agree, you can stop using the Services and turn off auto-renewal.
17. Governing law and disputes
These Terms are governed by the laws of India. Before starting formal proceedings, please contact us so we can try to resolve the dispute informally within 30 days. If it is not resolved, the courts of India have jurisdiction. If you are a consumer, you also keep any protections and rights to bring a claim that the law of your country gives you.
18. General
- If any part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, and will tell you if we do.
- These Terms, together with any order form or written agreement for Enterprise plans or Autonomous builds, are the whole agreement between us about the Services. If they conflict, the signed agreement wins.
